LUCKFIESTA DOES NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

IN NO EVENT SHALL LUCKFIESTA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE ANY PORTION OF THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID TO LUCKFIESTA FOR ACCESS TO THE SERVICE IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.
THE LIMITATIONS SET FORTH IN THIS SECTION SHALL NOT LIMIT OR EXCLUDE LIABILITY FOR GROSS NEGLIGENCE, FRAUD, INTENTIONAL, WILLFUL, MALICIOUS, OR RECKLESS MISCONDUCT, OR FOR ANY OTHER MATTERS IN WHICH LIABILITY CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms, violation of applicable laws or regulations, fraudulent or harmful conduct, or at our sole discretion.
Upon termination, your right to use the Service will immediately cease. Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms in our sole discretion without restriction.
